The employer will need to determine if the poor performance is down to capability or misconduct, it is often a question between can’t versus won’t
2. Since the recent Government changes can an employer implement a policy enforcing an employee to attend work if they have tested positive for Covid but are asymptomatic?
To comply with their duty of care towards employees, employers should encourage employees who test positive for Covid to follow the Government’s advice to stay at home
3. What can an employer do when an employee refuses to come to work?
Refusing to come to work will likely be a breach of contract, unless there are reasonable grounds for their refusal.
