Under the Employment Rights Act 2025 from 6th April 2026 a new obligation is coming into force requiring all employers to keep detailed records of employees’ holiday entitlement, holiday taken, and holiday pay for six years. Employers will be required to keep adequate records showing statutory and additional holiday taken by each worker, holiday pay calculations, holiday carried forward and payments in lieu of holiday. Failure to comply becomes a criminal offence. We would recommend you ensure your HR systems can track holiday entitlement and usage accurately and check your systems can retain data for six years.
